Juvenile diversion in Australia : a national review

Description

One of the most striking recent developments in juvenile justice in Australia has been the rapid expansion of ‘diversion’ options. This paper considers the meaning of the term ‘diversion’ and reviews the major diversionary strategies in the juvenile justice systems of different Australian states and territories. The paper profiles police cautioning of juveniles, including different approaches to this; juvenile conferencing, including the evidence on conferencing and recidivism, and other impacts of conferencing; the issue of diverting young offenders from detention on remand; a small number of focused model diversion programs in individual states; and the issue of diversion of Indigenous juvenile offenders. The paper is a summary of the report ‘Early intervention : diversion and youth conferencing – a national profile and review of current approaches to diverting juveniles from the criminal justice system’ by Kenneth Polk, Christine Alder, Damon Muller and Katherine Rechtman, prepared for the Crime Prevention Branch of the Commonwealth Attorney General?s Department (2003).
