People with Cognitive and Mental Health Impairments in the Criminal Justice System: Diversion

Description

This report discusses the provisions in the criminal justice system for people with cognitive and mental health impairments. The report tracks the stages where diversion is possible in the criminal justice system. The way that the Mental Health Act 2007 (NSW) and the Mental Health (Forensic Procedures) Act 1990 (NSW) provide for these diversion points is evaluated. This report also makes some recommendation for change.

This report is a useful source for data on cognitive and mental health impairment among Aboriginal people and Torres Strait Islanders, and the extent that this is connected to prison over representation.
