New South Wales Law Reform Commission Report: Bail

Description

This report finds that a new, simplified Bail Act is required. The report was made pursuant to a referral by the Attorney General. In highlighting the need to simplify the Bail Act, this report presents the background and principles of the Bail Act, the history of bail law, trends in remand and the consequences of remand. In discussion of reform, the report considers language and structure, discretions involved in bail, presumptions and the question of release pending appeal. Recommendations are made in light of this information.
